Terms of Service

1. About these terms
These Terms of Service ("Terms") govern any quote request, project booking, or use of this website operated by MotionNext ("we", "us", "our"), a studio based in the United Kingdom. By submitting a quote request or engaging us for a project, you ("client", "you") agree to these Terms.
2. Quotes and project scope
Quotes provided through our contact form or by email are estimates based on the information you provide. A final price and deliverable scope is confirmed in writing (email is sufficient) before work begins. Any change to scope, deliverables, or deadline after work has started may result in a revised quote.
3. Revisions
Each package includes a stated number of revision rounds on the first draft, as set out on our Pricing page or in your project quote. Additional revision rounds, or revisions requested after final delivery, may be billed separately.
4. Payment
Unless otherwise agreed in writing, projects are invoiced 50% upfront and 50% on delivery of the final draft. Work will not commence until the deposit is received, and final files will not be released until the balance is paid in full. Invoices are payable within 7 days unless otherwise stated.
5. Delivery and licensing
Final deliverables are provided in the formats agreed at the start of the project. Unless otherwise agreed in writing, delivered files are licensed to the client for use in their own marketing and commercial activity. We retain the right to display completed work in our portfolio and marketing materials unless you request otherwise in writing before project completion.
6. Source material and rights
You confirm that any product images, footage, logos, or other material you provide to us is either owned by you or you have the right to use it, and that its use will not infringe any third party's intellectual property rights. You agree to indemnify us against any claim arising from material you provide.
7. Cancellation
If a project is cancelled after work has started, the deposit is non-refundable and you will be billed for work completed up to the point of cancellation, calculated on a pro-rata basis.
8. Limitation of liability
To the maximum extent permitted by law, our total liability arising from any project is limited to the amount paid for that project. We are not liable for indirect or consequential losses, including loss of revenue or business opportunity.
9. Governing law
These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms or a project engagement is subject to the exclusive jurisdiction of the courts of England and Wales.
